Complaint with the advocate

The Advocate examines your petitions or complaints concerning alleged cases of discrimination.

He/she issues non-binding opinions on whether you are being discriminated against in a certain situation (subject to unequal treatment because of personal circumstances). The opinion the Advocate contains a recommendation to the offender on ways to eliminate the violation, its causes and consequences.

A proceeding before the Advocate is cost-free and confidential.

How can the Advocate help?

· PETITIONS (COMPLAINTS): The Advocate examines your petitions or complaints concerning alleged cases of discrimination. He/she issues non-binding opinions on whether you are being discriminated against in a certain situation (subject to unequal treatment because of personal circumstances). The opinion the Advocate contains a recommendation to the offender on ways to eliminate the violation, its causes and consequences. Through such non-formal intervention, the Advocate tries to eliminate the violation and provides help to improve future practice. When an issue cannot be resolved in this way, the Advocate may ask inspection authorities to prosecute the minor-offences and to impose fines. A proceeding before the Advocate is cost-free and confidential.

· ASSISTANCE: The Advocate provides assistance to discriminated persons in legal and other proceedings, i.e. by giving advise on legal remedies and how to use them before other national authorities.

· ADVICE: Anyone has the right to ask the Advocate for advice on whether their actions and omissions could result in discrimination, on how to act in order to avoid discrimination or how to effectively respect the right to equal treatment.

· INFORMATION: The Advocate provides general information on discrimination issues and the situation in this field in Slovenia.
